Welcome to Sessify. These Terms of Service (“Terms”) govern your access to and use of the Sessify platform, website, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
1. Overview
Sessify is a scheduling and booking platform that connects businesses offering services, classes, and appointments with clients seeking to book those services. Sessify acts as an intermediary, providing the technology platform to facilitate bookings and payments between businesses and their clients.
2. Definitions
- “Platform” refers to the Sessify website, applications, and services.
- “Business” refers to any individual or entity that creates a business profile on Sessify to offer services.
- “Client” refers to any individual who books services through the Platform.
- “User” refers to any person who accesses or uses the Platform, including Businesses and Clients.
- “Guest User” refers to a Client who makes a booking without creating an account.
3. Account Registration
3.1 Business Accounts
To offer services on Sessify, you must create a business account and provide accurate information including your business name, contact information, and timezone. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Client Accounts
Clients may create an account to manage their bookings across multiple businesses. Alternatively, Clients may book as guests by providing their email address and name without creating an account.
3.3 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
4. Services and Bookings
4.1 Booking Services
Clients may browse business profiles and book available services, including classes (group sessions) and appointments (one-on-one sessions). All bookings are subject to availability and the terms set by each Business.
4.2 Business Terms
Businesses may establish their own terms, cancellation policies, and requirements for their services. Clients agree to review and accept any Business-specific terms before completing a booking.
4.3 Booking Confirmation
A booking is confirmed once payment is successfully processed (for paid services) or upon submission (for free services or pay-in-person options). Clients will receive a confirmation number for their records.
4.4 Cancellations and Modifications
- Clients may cancel confirmed bookings for future events through the Platform.
- Appointments may be rescheduled to a different available time slot, subject to availability.
- Classes cannot be rescheduled; Clients must cancel and rebook.
- Past bookings cannot be cancelled or modified.
- Businesses may also cancel bookings, in which case Clients will be notified.
4.5 No-Shows
Businesses may mark Clients as no-shows if they fail to attend a confirmed booking without cancellation.
5. Payments
5.1 Payment Processing
Sessify uses Stripe Connect to process payments. When you make a payment through the Platform, you are paying the Business directly through their connected Stripe account. Sessify does not hold or manage funds on behalf of Businesses or Clients.
5.2 Platform Fees
Sessify charges Businesses a platform fee of 0.9% on each transaction, in addition to standard payment processing fees charged by Stripe.
5.3 Payment Methods
The Platform supports various payment methods including:
- Credit and debit cards
- Digital wallets
- Pay-in-person (at the Business’s discretion)
5.4 Refunds
Refund policies are determined by each Business. Clients seeking refunds should contact the Business directly. Sessify is not responsible for issuing refunds for services booked through the Platform.
5.5 Payment Disputes
Any disputes regarding payments, chargebacks, or billing issues should be resolved between the Client and the Business. Sessify may assist in facilitating communication but is not a party to the transaction.
6. Business Responsibilities
Businesses using the Platform agree to:
- Provide accurate descriptions of their services, pricing, and availability
- Honor confirmed bookings unless cancellation is necessary
- Comply with all applicable laws, regulations, and licensing requirements for their services
- Maintain appropriate insurance for their business activities
- Respond to Client inquiries and booking requests in a timely manner
- Set clear cancellation and refund policies
- Comply with Stripe’s terms of service for payment processing
7. Client Responsibilities
Clients using the Platform agree to:
- Provide accurate contact information when booking
- Arrive on time for confirmed bookings
- Cancel or reschedule bookings in accordance with Business policies
- Pay for services as agreed upon booking
- Treat Businesses and their staff with respect
8. Prohibited Conduct
Users may not:
- Use the Platform for any unlawful purpose
- Create fraudulent bookings or provide false information
- Attempt to circumvent payment processing or platform fees
- Harass, abuse, or harm other Users
- Interfere with or disrupt the Platform’s operation
- Scrape, data mine, or use automated systems to access the Platform
- Impersonate any person or entity
- Upload malicious content or code
9. Intellectual Property
9.1 Sessify Content
The Platform, including its design, features, and functionality, is owned by Sessify and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
9.2 User Content
Businesses retain ownership of content they upload to the Platform, including profile information, service descriptions, and photos. By uploading content, Businesses grant Sessify a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Platform.
9.3 Feedback
Any feedback, suggestions, or ideas you provide about the Platform may be used by Sessify without obligation or compensation to you.
10. Privacy
Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the collection and use of information as described in the Privacy Policy.
11. Disclaimers
11.1 Platform Provided “As Is”
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 No Guarantee of Availability
Sessify does not guarantee that the Platform will be available at all times or without interruption. We may perform maintenance, updates, or modifications that temporarily affect availability.
11.3 Third-Party Services
The Platform integrates with third-party services, including Stripe for payment processing. Sessify is not responsible for the availability, accuracy, or reliability of third-party services.
11.4 Business-Client Relationships
Sessify is not a party to agreements between Businesses and Clients. We do not endorse, guarantee, or assume responsibility for the quality, safety, or legality of services offered by Businesses.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SESSIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.
SESSIFY’S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO SESSIFY (NOT TO BUSINESSES) IN THE TWELVE MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Sessify and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any rights of another party
- Content you upload to the Platform
14. Modifications to Terms
Sessify may modify these Terms at any time by posting updated Terms on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms. We will provide notice of material changes through the Platform or by email.
15. Termination
15.1 By Users
You may terminate your account at any time by contacting us or through account settings. Termination does not affect obligations arising before termination, including pending bookings and payments.
15.2 By Sessify
Sessify may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms, fraudulent activity, or extended inactivity.
15.3 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, indemnification, and limitations of liability.
16. Dispute Resolution
16.1 Informal Resolution
Before filing any formal dispute, you agree to attempt to resolve the dispute informally by contacting us. We will attempt to resolve the dispute through good-faith negotiations.
16.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
16.3 Jurisdiction
Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in the State of Delaware.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Privacy Policy and any Business-specific terms, constitute the entire agreement between you and Sessify regarding the Platform.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17.3 Waiver
Failure by Sessify to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
17.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. Sessify may assign its rights and obligations without restriction.
